(Title 17, US Code) - July 2002 | Questioning the evidence: Danielle's fingerprint found in Westerfield's RV: More than 300 fingerprints were lifted from surfaces in the Van Dam's house. An expert testified that after testing them against Danielle's parents and brothers only 122 were positively identified. He also testified a backward palm print found on the handrail of the family's staircase did not match the Van Dams, nor Westerfield nor the sexpals that were there that night. Danielles' hands couldn't be examined because they were mummified. The medical examiner had to remove them from Danielle's body and rehydrate them to get back to appearing natural. According to the preliminary hearing, a San Diego Police expert compared the fingerprints from Danielle's rehydrated hand with a photograph taken in Westerfield's motorhome and concluded that prints of the middle and ring fingers were made by Danielle Van Dam. Extracts from preliminary hearing: Feldman: All right. And, sir, are any universities or colleges offering degrees in fingerprints? Mr. Dusek: objection. irrelevant. The court: overruled. The witness: I really don't know. I don't believe so, no. Feldman: you don't have a college degree in fingerprints? The witness: no, I don't. Feldman: there is no test you take to be a fingerprint examiner, is there? The witness: there is not. Etc. etc. The expert acknowledged having found no fingerprints at all from Westerfield in his own motorhome and having no idea who is the owner of the backward palm print found in the Van Dam's house. |
