Right after this sentencing, two members of this fine panel revealed to the world how the twelve reached their unanimous (?) verdict of "guilty on all counts" after phase I (trial) and "death" after phase II (penalty). They proudly explained that they based their conviction principally on the blood stain found on Westerfield's jacket. It is interesting to note that they never saw the blood on the jacket. At trial, prosecution brought a jacket with holes and not even one photography of this blood stain. ![]() Trial: Westerfield's jacket, WHERE is this blood that the dry cleaner never saw? White parts are holes... overwhelming incriminating evidence for the jury.... The foreman, juror number 10 and the other guy, juror number 6 answered several questions asked by the media. Here is what I come up with, I will resume their answers below: 1) How the crime was committed: no importance 2) When the crime was committed: no interest 3) No evidence Westerfield kidnapped Danielle: irrelevant 4) No evidence Westerfield killed Danielle: so what? 5) No evidence Westerfield ever entered the Van Dam's house: not our problem 6) Testimonies of bug experts that Westerfield couldn't not have dumped Danielle's body : entomology is not an exact science 7) Prosecution case didn't even make sense: we didn't have to fill the gaps 8) Brenda Van Dam possibly bringing total strangers at home: what does it have to do with Danielle's death? 9) Damon Van Dam possibly having sex with Barbara while his kids were asleep next door: has nothing to do with the case 10) Both parents lying to the cops: everybody lies to cops 11) Blood found in Danielle's bedroom, which was not Westerfield's: no comments 12) Unidentifed fingerprints in the Van Dam's house: a mailman? 13) Unidentified hair found on Danielle's body: why do you ask us? 14) Barbara Easton, one of the main witnesses, never testified : Barbara who? Etc. etc. How could have the jury known if entomology is an exact science or not ? Where did they get their information? At home when they were not supposed to discuss the case? From newspapers they were not supposed to read? From the TV they were not supposed to watch? The overwhelming incriminating evidence that the dry cleaner and jury never saw: ONE blood stain on the jacket which size was described as approximately 3 cm long (one and three-sixteenths of an inch), was a key piece of evidence for the twelve to be convinced that Westerfield kidnapped and killed Danielle Van Dam and deserved the death penalty. The other key overwhelming incriminating evidence is a blood stain located on the floor carpet between the bathroom and the closet in Westerfield's motor home. Stain described as approximatively 1/4 inch in diameter. There is no other blood found identified as Danielle's that could be connected to Westerfield. During deliberations the jury never read any testimony. If they wanted to go back on witness testimony, a guy came in and read it aloud. This way, unless jurors have an extraordinary memory, it was impossible to compare testimony and see the obvious contradictions between them. If you wonder how tax payer money is wasted, wonder no more, we just had a perfect example. Justice has been served beyond any reasonable doubt! |
